Medical Malpractice / Medical Negligence
Medical negligence or medical malpractice is a phrase that refers to medical care that is tainted by a negligent act or omission by a medical professional, hospital or other facility that results in injury to an individual.
When cases of medical negligence happen, the injured person is able to take these professionals and organizations to court by filing a personal injury lawsuit.
Negligence generally arises when medical professionals do not adhere to certain standards. Usually physicians performing irresponsible or erroneous actions and/or not taking care of things that should have been taken care of. Lack of skill, care, or timeliness can be the cause for medical negligence/medical malpractice claims. Any person, doctor, nurse or specialist, that accepts any part of the responsibility for a patient's medical care can be held liable for medical malpractice.
Professionals who assume psychological care are also responsible for the care of their patients and could be charged with medical negligence. Medical facilities also are an important factor in patient care and they too can be held liable.
